Welcome to Zukiru ("Service," "we," "us," "our"). By accessing or using the Service, you agree to these Terms and Conditions ("Terms"). If you do not agree with any part, you must discontinue use immediately.

1. Scope of Service

Zukiru is a social media platform that allows users to:

  • Create profiles
  • Share posts, media, and other user-generated content
  • Follow and interact with other users

Some features may be limited based on region, age, or account type.

2. Eligibility

You must be at least 13 years old to use the Service, or older if required by local law. If under 18, parental/guardian consent is required. You confirm that:

  • You have legal capacity to agree to these Terms
  • The information you provide is accurate and current

3. Account Registration & Security

You must maintain the confidentiality of your login credentials and take responsibility for all actions under your account.

We reserve the right to:

  • Reject usernames that impersonate others or violate our policies
  • Suspend or delete accounts for security concerns or legal compliance

4. User Responsibilities

You agree not to:

  • Violate applicable EU, national, or international laws
  • Harass, threaten, or incite harm against others
  • Post illegal, defamatory, hateful, extremist, explicit, or misleading content
  • Upload or distribute malware, spam, or automated scraping
  • Attempt to breach security or reverse-engineer features
  • Impersonate others or misrepresent your identity

We may remove content or restrict access if these conditions are violated, in line with the EU Digital Services Act (DSA).

5. User-Generated Content & Licensing

Ownership

You retain all intellectual property rights to content you post.

License Granted to Us

By uploading content, you grant us a non-exclusive, royalty-free, transferable, worldwide license to:

  • Store, host, reproduce, adapt, publicly display, and distribute content within the Service
  • Use content to operate, promote, improve, and secure the platform

This license persists until you delete the content or your account, except where:

  • Content has been shared, reshared, or quoted by other users
  • Legal obligations require retention (e.g., fraud, enforcement requests)

You confirm you have rights to publish any content you upload.

6. Privacy & GDPR Compliance

Our Privacy Policy explains how we handle personal data under the General Data Protection Regulation (GDPR).

Under GDPR, EU users have the right to:

  • Access and correct personal data
  • Request deletion ("Right to be Forgotten")
  • Restrict or object to processing
  • Data portability
  • Withdraw consent at any time without affecting prior lawful processing
  • Lodge complaints with a Data Protection Authority (e.g., your national DPA)

We act as:

  • Data Controller for user accounts and interactions
  • Data Processor for content and optional integrations where applicable

We apply:

7. Cookies & Tracking Technologies

We don't use any kind of cookies for Service functionality, analytics, and security.

We only use your browser's local storage to manage authorization and keep your session working securely.

8. Safety & Content Moderation (DSA Compliance)

We maintain notice-and-action procedures in accordance with the Digital Services Act.

Users may report:

  • Illegal content
  • Harassment or harmful behavior
  • Impersonation
  • Terms violations

We provide:

  • Transparent moderation decisions
  • Ability to appeal moderation actions
  • Information on automated moderation tools used

We may cooperate with lawful EU authorities when required.

9. Following, Messaging & Interactions

We do not actively monitor private interactions. Users are responsible for their own behavior and communications. Report abuse directly via platform tools.

10. Intellectual Property & Platform Rights

All software, branding, design, and functionality belong to Zukiru and licensors.

You may not:

  • Copy, modify, or reverse engineer platform components
  • Use branding without written permission
  • Mine data outside permitted exports under GDPR

11. Third-Party Services

The Service may display or integrate content from third-party websites. We are not liable for third-party behavior, data handling, or content.

Use of third parties is at your own risk and governed by their terms.

12. Consumer Rights (EU Law)

Under the E-Commerce Directive and Consumer Rights Directive, users have:

  • Right to clear service information
  • Ability to cancel paid subscriptions (if offered)
  • Transparent pricing before purchase
  • Refund rights where applicable

Free use of the platform does not create commercial rights.

13. Termination

We may suspend or terminate accounts where:

  • Terms are violated
  • Required by law, safety, or operational needs
  • Requested by the account holder

We will notify users with reasons and appeal options unless restricted by law.

Upon termination:

  • Access stops immediately
  • Certain data may be retained for compliance

14. Disclaimers

We provide the Service as-is and:

  • Do not guarantee uninterrupted or error-free operation
  • Are not responsible for user disputes or harmful interactions
  • Do not guarantee accuracy of user-generated content

Use of the Service is at your own risk.

15. Limitation of Liability

To the fullest extent allowed by law, we are not liable for:

  • Lost data, profits, revenues, or business opportunities
  • Personal injury or reputational harm
  • Indirect, incidental, or punitive damages

Our maximum liability is limited to €100 EUR or the amount you've paid us in the last 12 months - whichever is greater.

Some EU states may not allow certain limitations, so parts may not apply to you.

16. Indemnification

You agree to indemnify and hold us harmless from any claims arising from:

  • Your content
  • Your misuse of the Service
  • Your violations of the law or these Terms

17. Changes to These Terms

We may update these Terms at any time to reflect:

  • Legal requirements (e.g., GDPR, DSA updates)
  • Feature or policy changes
  • Security improvements

We will notify users via the platform. Continued use constitutes acceptance of updated Terms.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of Romania

Disputes will be settled by:

  • Local courts of the same jurisdiction, or
  • Structured alternative dispute resolution where available

Consumers retain mandatory rights under EU law regardless of jurisdiction choice.
